Judge Won’t Block Elon Musk’s $1 Million Voter Giveaway While He Tries to Move Case

According to Reuters, a Pennsylvania state judge announced Thursday that he would hold off on a lawsuit aiming to stop Elon Musk’s $1 million voter giveaway until a federal court decides if it will handle the case. This delay allows Musk to continue the giveaway ahead of the Nov. 5 presidential election. Musk, who supports Donald Trump, was asked to attend the hearing but did not appear.

Philadelphia District Attorney Larry Krasner filed the suit, claiming Musk’s initiative is an “illegal lottery” designed to sway voters. The giveaway targets registered voters in key states and offers $1 million to random participants pledging support for free speech and gun rights. Musk handed out the first check at a rally in Harrisburg on Oct. 19.

Krasner argues the giveaway misleads participants, lacks clear rules, and questions how voters’ data is protected. He noted that past winners had ties to Trump events, casting doubt on the “random selection.” Musk’s lawyer dismissed the lawsuit as a publicity stunt, claiming America PAC alone should be the defendant.

After the hearing, Musk posted “American Justice FTW” on X. Krasner has asked for additional security due to inflammatory online comments, some antisemitic, aimed at him. The case remains a point of debate, as legal experts differ on whether Musk’s actions could break federal election laws.
